Overview
Your Family Photo is operated by Flightpath Publishing, Inc. In these Terms, “we,” “us” and “our” mean Flightpath Publishing, Inc., trading as Your Family Photo. These Terms cover your use of yourfamilyphoto.com and your purchase of our photo-restoration and framed-print service.
Please read these Terms together with our Refund Policy and the PerfectRestore™ Guarantee, Shipping Policy and Privacy Policy. The Promise takes priority if another part of these Terms appears to limit a remedy it offers. The Privacy Policy governs how personal information is handled.
By placing an order, you agree to the terms presented to you at checkout. Nothing in these Terms takes away rights that the law gives you and does not allow us to exclude.
1. Who can order
You must be at least 18 and legally able to enter into a contract where you live. You must provide accurate order and contact details and be authorized to use the payment method you choose. If you order on another person's behalf, you must have authority to do so.
Our launch service delivers to the contiguous United States. See the Shipping Policy for the addresses we can serve.
2. Our service
Each order covers the restoration of one photograph and the framed print described on the product page and confirmed on your proof. The included digital files and available finish, frame and mat choices are described there too. We accept digital uploads; please do not mail an original photograph to us.
We use image-processing tools, including AI-assisted tools, with human review. Restoration can improve a photograph, but cannot establish historical details that the source does not show. Colorization of a black-and-white original is an interpretation, and we label it that way on the proof and digital file. We do not offer the addition or removal of people or the invention of faces.
If a preview is shown before purchase, it is labeled as a preview. It is not the final reviewed proof or an authorization to print. A person reviews the proposed restoration against your original before we ask you to approve it.
If we cannot produce a result you approve, you receive a full refund under our Refund Policy. Source-photo limitations do not remove the YourFamilyPhoto Promise from an accepted order.
3. Your photograph and permission to use it
You retain the rights you have in your original photo. Uploading it does not transfer its ownership to us. You must own the relevant rights or have the permissions or other lawful authority needed for us to restore, copy, print and deliver it. Owning a physical print or being pictured in a photo does not necessarily mean you own its copyright.
Please do not upload material that is unlawful, infringes another person's rights, or includes information that is unnecessary for the order. If a photo includes a child, submit it only if you have the permission or other lawful authority needed to have it processed. We may ask for clarification or decline an order when there is a reasonable concern about rights or lawful use. If we stop the order before printing, we will notify you, provide a full refund and not print it.
You give us a non-exclusive permission to receive, store, copy, edit, show privately to you, print and deliver your submitted files solely to provide your requested service, handle corrections and remedies, and meet related legal obligations. We may give service providers only the access and permission necessary to perform those tasks for us. Retention and deletion are described in the Privacy Policy.
This permission does not authorize advertising, public portfolios, sale of your photos, or training AI models on your photos. Any proposed marketing use requires separate, optional permission. Saying no does not affect your order or your rights under the Promise.
To the extent we hold rights in restoration work added by us, we give you permission to keep, share and print the delivered file for your personal and family use without an additional charge. This does not grant rights that belong to someone else or transfer ownership of our software, methods or branding. Please keep your own copies of originals and delivered files; the service is not a permanent photo archive.
4. Proofs, corrections and approval
Nothing is printed until you approve your proof. Please check the photo, faces, finish, frame, mat, dimensions and delivery details before approval. We will keep working with you on changes until you are happy with the proof.
Changes to the restoration and available proof choices, such as finish, warmth, brightness, frame finish, mat color and original-border preference, are included. We will tell you if a request falls outside the service; we will never add a charge without your agreement.
Either you or we may stop the order for any reason before printing begins, subject to applicable law. If either party stops, you receive a full refund and the photo will not be printed. You do not have to show a defect or use up any process before choosing to stop. If we stop, we will notify you.
After approval, you have a 60-minute undo window before we release the order for production. Use the undo control on the proof page or email us within that period to pause release, request changes or cancel for a full refund. Undoing approval pauses the order; tell us if you also want to cancel. Any changed proof needs your approval before it can be printed.
After the undo window ends, an approved order may proceed to printing. Approval, the end of the undo window and release to production do not remove the right of either party to stop before printing begins. Once printing has begun, we cannot promise to change or stop the physical order, but the YourFamilyPhoto Promise and your legal rights remain in place. The Refund Policy explains your options.
If we are waiting for your photo, instructions or approval, we will not print without your approval or cancel simply because a routine reminder goes unanswered. We will contact you to ask whether you want to continue, keep holding or receive a refund. If a shipping delay requires a legal notice, we will explain the choices and response deadline. Where the law requires cancellation and a refund if we do not receive consent to a further delay, we will follow that requirement. The Shipping and Refund Policies explain the process.
5. Orders and payment
Your checkout shows the product, price, any applicable tax and any shipping charge before you pay. Prices are in US dollars unless checkout expressly says otherwise. This is a one-time purchase, not a subscription.
We confirm receipt of your order by email. If a payment cannot be completed, an address is outside our delivery area, your requested product is unavailable, or we cannot lawfully or suitably fulfill the order, we will contact you. We will not substitute a materially different product without your agreement. If we cannot fulfill an order for which we have taken payment, we will provide a full refund.
Please keep your email and delivery details current. Tell us promptly if you notice an error. We may make reasonable checks to prevent fraud, but will not use those checks to remove refund or consumer rights.
6. Prices, descriptions and errors
Product availability and prices may change for future purchases. A later price change does not alter a confirmed order. We aim to keep descriptions accurate. If an error materially affects your order, we will explain it and offer an appropriate correction you agree to or a full refund; we will not silently increase the price.
Screens and printed photographs can display colors differently. Frame imagery may include illustrative mockups, identified as such. Your proof confirms the ordered configuration. These limitations do not restrict the Promise if you do not love the delivered result.
7. Production, shipping and delivery
Our US print partner produces and ships the approved framed photo. Your purchase is with us, and we remain your contact for delivery problems and remedies. You do not have to pursue our supplier or carrier to exercise the Promise.
The Shipping Policy explains our delivery area, shipping costs, production stages and how we handle delays. Any estimate depends on receiving the material and approval needed to complete the order. We will explain delays and offer cancellation or a refund where required. Carrier estimates are not a waiver of your rights for non-delivery.
8. Refunds and the YourFamilyPhoto Promise
If you do not love your finished family photo, contact us within 30 days after delivery and choose a free revision and replacement, shipped at our cost, or a full refund to the original payment method. No return is required. If you choose a replacement and remain unhappy, the refund option stays open for 30 days after the replacement arrives.
Damage, a wrong item and non-delivery are also covered by the Refund Policy. Proof approval and the personalized nature of the frame do not remove this protection. Read the Refund Policy for the complete terms, cancellation options and how to contact us.
9. Shopify, service providers and third-party links
Our store is hosted by Shopify, which provides the commerce platform. Your purchase contract is with Flightpath Publishing, Inc., not Shopify. We use providers for functions such as payment processing, photo processing, printing, shipping and communications.
Shopify and our other providers process information needed to provide their services. Information may be processed in countries other than your own, as explained in our Privacy Policy. Shopify also describes its own processing in its Consumer Privacy Policy and provides a privacy portal for applicable rights and choices. See our Privacy Policy for the data uses and privacy controls that apply to this store.
We use Shopify Network Intelligence and enhanced services that use information about your visits and purchases together with your interactions with other merchants and Shopify. Information is shared with Shopify and other providers, which may be in other countries, to support those services, including personalized shopping, advertising and measurement. The Privacy Policy explains the available privacy choices. This does not give permission to use your uploaded photographs for advertising or model training.
Links to independent websites do not make those sites part of our service. Their own terms apply when you use them. This does not reduce our responsibility for carrying out your order through providers we appoint.
10. Privacy and communications
Our Privacy Policy explains the information we handle, including uploaded photos, recipient details and order information, and how to exercise privacy choices. Providing a photo for restoration is not permission to publish it.
We use the buyer's contact details for order confirmations, proofs, reminders, shipping updates and customer service. Marketing choices are separate from those necessary service communications. You can unsubscribe from marketing without losing order updates or support. These Terms do not enroll you in marketing text messages.
11. Reviews and feedback
You may share an honest review of your experience, including a negative review. We do not make a refund, replacement or other remedy conditional on removing or changing a review.
If you choose to submit a review for publication on our store, you permit us to display that review with the public name you provide. You retain your rights in it. We may remove private information, unlawful material, spam or content unrelated to the service under a policy applied without regard to whether a review is positive or negative. We will not change the substance of your opinion.
Submitting a service photo is separate from submitting a public review. We obtain separate permission before using your private restoration photos in advertising or promotional examples.
12. Acceptable use
Do not use the service for unlawful activity; upload malware; attempt unauthorized access; impersonate another person; submit payment details you are not authorized to use; or interfere with other customers' use of the service. Do not submit material that you lack the right to have processed.
We may restrict access when reasonably necessary to protect people, the service or legal rights. Restrictions do not extinguish your rights relating to a paid order or allow us to keep payment for an order we will not fulfill.
13. Our website and intellectual property
Our website copy, branding and software belong to us or our licensors. These Terms allow ordinary personal use of the site and do not give permission to copy our branding or exploit our software. This does not limit your rights in your photos, delivered files or reviews, or any use the law permits.
14. Service availability and responsibility
We take reasonable care in providing the service, but websites and digital communications can sometimes be interrupted or contain errors. Let us know about a problem so we can address it.
Our stated product commitments, the Promise and applicable consumer protections continue to apply. We do not exclude liability for fraud, willful misconduct, personal injury caused by our negligence, or any responsibility that cannot lawfully be excluded. These Terms do not impose a blanket waiver of product warranties, require you to indemnify us for ordinary use, or limit a promised refund to store credit.
15. Stopping use or ending an order
You may stop using the website at any time. Either you or we may stop a paid order for any reason before printing begins, subject to applicable law. If either party stops, we provide a full refund and do not print the photo. We will notify you if we stop an order. Follow the Refund Policy to request cancellation or another remedy. Rights to remedies, privacy protections and obligations that should reasonably continue after an order ends remain in effect.
16. Governing law and resolving concerns
These Terms and any dispute are subject to the applicable laws of the United States and the relevant state, including mandatory consumer protections. These Terms do not require you to give up protections or access to courts available under the law that applies to you.
Please contact us if there is a problem so we can try to resolve it. Contacting us is not a requirement that delays a legal deadline or prevents you from exercising a legal right. These Terms do not require arbitration, waive class-action rights or require a dispute to be brought in a foreign country.
17. Changes to these Terms
We may update these Terms for future use of the site and future orders. We will show the effective date and give any additional notice required by law. A later change will not reduce the Promise or other terms that applied when you placed an existing order without your agreement.
18. General provisions
These Terms, the policies linked above and the order details presented at purchase form the agreement for the service. They do not exclude a representation or right that cannot lawfully be excluded. If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not by itself waive that right.
If the business is transferred, any successor remains responsible for existing customer obligations. A transfer does not reduce your rights under an existing order or permit a new use of personal information contrary to the Privacy Policy or applicable law.
